Employment Application??!!??

I just had a prospective send me an employment application for what was billed as a freelance, telecommute, contract project.


I had to write back and tell them that it was highly irregular (and violated IRS regulations) and that, if they were seeking an employee, I would withdraw my "candidacy".


I'll either score major "brownie points" for knowing the Rules and Regs or they'll eventually find themselves paying taxes, penalties and back-benefits on whoever they get who is willing to fill out their form. Sigh.

It's people like that who don't really understand what a virtual assistant is. Use it to educate them. :)

I'm confused. My understanding is that were hiring you under the banner of an employee? I'd love more clarification. Sorry for the confusion ;)


Is it possible they don't understand this regulation and you are saving their neck? They would be grateful.

Their post requested a freelancer to telecommute and work on a contract basis.

They used all of those terms, so it seemed pretty straightforward!

Until they emailed me an employment application...


Since writing back to them, I haven't received a reply. C'est la vie. I guess they wanted an employee ;)


I read recently about a court ruling against FedEx for saying their drivers in Kansas were ICs (they were employees) in order to cut costs. You never know whether someone is confused, ignorant of the laws or willfully disregarding them.
